Agreement to Terms

By accessing and using Rachael's Rentals services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.

Rental Requirements

Age and License Requirements

• All drivers must be at least 21 years of age
• A valid driver's license is required and must be uploaded at booking time
• License must be government-issued and unexpired
• Additional drivers must also meet all requirements and be listed on the rental agreement

Reservations and Payment

Booking and Confirmation

• Reservations can be made online through our website
• A credit or debit card is required to secure your reservation
• You will receive a confirmation email with your booking details

Payment Terms

• Full payment is required at time of booking
• We accept major credit cards (Visa, Mastercard, American Express, Discover)
• A security deposit will be held on your card during the rental period
• Additional charges will apply for late returns, damage, or violations

Cancellation Policy

• More than 48 hours before rental: Full refund
• 24-48 hours before rental: 50% refund
• Less than 24 hours before rental: No refund
• Cancellations due to weather or ferry service disruptions may be eligible for full refund or rescheduling

Golf Cart Operation and Safety

Operating Rules

• Driver must have a valid driver's license and be listed on the rental agreement
• No driving on beaches or in water
• Stay on designated roads only
• No reckless or negligent operation
• Seat belts must be worn at all times (where equipped)
• Do not exceed the passenger capacity of the cart

Prohibited Activities

• Operating the golf cart while under the influence of alcohol or drugs
• Allowing unlicensed or underage persons to operate the cart
• Using the cart for commercial purposes or ride-sharing
• Removing the cart from Water Island
• Modifying, tampering with, or disabling any cart components
• Overloading the cart beyond its rated capacity

Liability and Insurance

Renter Responsibility

You are responsible for the golf cart during the entire rental period. This includes:

• Any damage to the cart (collision, vandalism, weather damage)
• Loss or theft of the cart or its accessories
• Traffic violations or fines incurred during your rental
• Injuries to yourself or passengers resulting from cart operation
• Damage to third-party property caused by the cart

Damage and Loss

In the event of damage or loss:

• You must report any accidents or damage immediately
• You are responsible for the cost of repairs up to the full replacement value
• Your credit card on file will be charged for damages
• You may be responsible for loss of rental income during repair period

Rental Period and Returns

Pickup and Return

• Golf carts must be picked up and returned at our designated location
• Rental periods are calculated from pickup time to return time
• Late return fee of $50
• Pickup & Returns after business hours must be arranged in advance

Condition Upon Return

• Cart must be returned in the same condition as received
• Excessive dirt or debris may result in cleaning fees
• All accessories and equipment must be returned

Breakdowns and Mechanical Issues

If you experience any mechanical issues during your rental:

• Contact us immediately at (340) 514-1483
• Do not attempt to repair the cart yourself
• We will provide a replacement cart or issue a prorated refund
• You are not responsible for mechanical failures due to normal wear and tear

Limitation of Liability

To the fullest extent permitted by law:

• Rachael's Rentals is not liable for any injuries, accidents, or damages that occur during your rental period
• We are not responsible for personal belongings left in or stolen from the cart
• We make no warranties regarding road conditions, weather, or ferry service availability
• You agree to indemnify and hold Rachael's Rentals harmless from any claims arising from your use of the cart

Privacy and Data

Your personal information is protected under our Privacy Policy. By using our services, you consent to our collection and use of your information as described in that policy.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the new terms.

Governing Law

These Terms of Service are governed by the laws of the U.S. Virgin Islands. Any disputes arising from these terms or your use of our services shall be resolved in the courts of the U.S. Virgin Islands.
